Can You Assume an FHA or USDA Mortgage?

FHA forward mortgages can be assumable by an approved buyer. USDA requires a closer look: Guaranteed and Direct loans follow different rules, and a USDA label does not establish the buyer's approval, terms or seller release. Identify the program and permitted transfer before negotiating around an assumption.

The existing balance is only part of the purchase price. Even a valid assumption can fail if the buyer cannot fund the seller's equity, meet qualification requirements or obtain the required approvals. Start with those questions before paying for a transaction built around a rate in a listing.

FHA: assumable does not mean approval is automatic

FHA's assumption regulation addresses creditworthiness when approval is required, alongside specified transfer exceptions and applicable occupancy limits. A buyer should obtain the servicer's requirements for that actual mortgage. [1]

Request an assumption package showing who reviews the application, what financial records are needed, the permitted occupancy and the fees. Provide accurate income, debts, assets and intended use. A seller's statement that the mortgage is assumable is a starting point for verification.

Also request the current principal balance, interest rate, maturity date and payment breakdown. Confirm whether the loan has modifications, deferred amounts, partial claims or other associated obligations. An online mortgage statement may not show the full structure a settlement professional must resolve.

This discussion concerns FHA forward mortgages. A HECM reverse mortgage has different eligibility, repayment and surviving spouse rules; the ordinary buyer assumption process described here should not be applied to one.

USDA Guaranteed: the transfer category comes first

USDA Guaranteed loans are made by participating lenders and guaranteed by USDA. The transfer regulation permits an agency approved assumption when its conditions are met, including buyer eligibility, acceptable property, underwriting and lien priority. It also requires the transferor to remain personally liable and provides for a new guarantee fee. Protected family transfers receive separate treatment. [2]

USDA's servicing handbook describes the protected family transfer route, including continued transferor liability for an assumption under that route. It also provides procedures for retaining existing terms or, when eligible and approved, using new terms. [3]

Ask the servicer to identify exactly which provision permits the proposed transaction. For an ordinary buyer, ask who will obtain agency approval, whether the property and household meet the applicable requirements, and what rate and remaining term will be approved. Have an advertised assumption verified before proposing a closing date.

If the approved assumption is unavailable or its liability terms are unacceptable, a buyer may instead need a new USDA mortgage or another new loan. That is new financing with its own approval and pricing. It does not inherit the seller's rate simply because the house previously secured a USDA loan.

USDA Direct: another program, another process

USDA Direct loans are made by the agency. USDA's Direct servicing handbook distinguishes assumptions at new rates and terms, typically associated with a sale, from limited transfers eligible for the same rates and terms. It also addresses subsidy eligibility and release of personal liability. [4]

The seller's effective payment may reflect payment assistance. A new household should not assume it will receive that assistance or the same effective payment. Obtain the agency's written treatment of the loan, assistance and any applicable subsidy recapture.

For a Direct loan, ask the responsible USDA office about borrower eligibility, property requirements, the approved assumption structure and the buyer's full payment. A general conversation with a lender that originates Guaranteed loans does not establish approval for an agency Direct transaction.

Put the programs beside each other

Existing loan ** Question to resolve first** ** Commitment needed before relying on it**
FHA forward mortgage What assumption and credit review apply to this loan and buyer? Servicer approval, actual terms and seller release treatment
USDA Guaranteed mortgage Will USDA approve the buyer, property and proposed terms? Written program determination and required approval
USDA Direct mortgage Is this a new terms assumption or an eligible same terms transfer? Agency eligibility, payment and release decision
Loan type is unclear Who owns, insures or guarantees the mortgage? Verified program identification from the current records

For a divorce or inheritance, begin with the family transfer and assumption guide. Ownership protection and successor servicing access should not be confused with a purchase assumption or a release.

The site also has a separate VA assumption guide. Its entitlement rules do not carry over to FHA or USDA.

Does the seller remain liable?

A buyer taking responsibility does not by itself prove the seller has been released. For FHA, the regulation provides a process involving a creditworthiness determination, assumption of personal liability and a written release when its conditions are met. [5]

Make the requested release explicit in the application and contract planning. At closing, the seller should receive the required written evidence, not just the buyer's promise to make payments.

USDA release treatment depends on the actual program and transfer route. For a Guaranteed assumption, the regulation requires the transferor to remain personally liable; the protected transfer procedure also addresses continued liability. A seller whose essential condition is a full release needs that issue resolved before agreeing to the structure.

Counsel can explain what any indemnity or private agreement accomplishes between the parties. It should not be described as the creditor's release. If the required release is unavailable, paying off the existing loan through a new mortgage or sale may be necessary.

Review escrow, insurance and the remaining term

Ask for a written payment breakdown showing principal and interest, escrow, mortgage insurance or applicable annual charges, and any separate obligation. Request a projection based on the buyer's actual insurance and anticipated property tax treatment.

Changing owners does not automatically eliminate FHA mortgage insurance or USDA charges. Have the servicer confirm the applicable schedule and remaining requirements. Likewise, retaining an existing note does not automatically give the buyer a fresh thirty year repayment period.

Escrow needs an actual settlement reconciliation. Find out whether the existing account continues, is adjusted or is handled another way under the approved transaction. Confirm how taxes already paid, insurance premiums and any shortage are allocated. A displayed escrow balance is not automatically cash the seller can collect separately from closing.

The property's insurance must support the new ownership and occupancy. For a Florida home, obtain an insurance quote early enough to evaluate the full cost. The seller's current premium is not a reliable quote for the buyer.

The seller's equity is a separate funding problem

Suppose a hypothetical purchase price is $365,000 and the approved assumed balance at closing is $225,000. The price gap is $140,000 before costs, deposits, credits and adjustments.

If the buyer has $90,000 available toward that gap, another $50,000 is still needed. A closing worksheet showing only the assumed balance and the buyer's cash is incomplete until it identifies the remaining source.

Possible sources include additional verified savings, accepted gifts, net proceeds from another sale or a permitted second mortgage. Each source must be acceptable for the actual transaction. Gifts cannot conceal a repayment agreement, and projected sale proceeds need a credible closing sequence.

A second mortgage is possible only if the assumption program, existing lien requirements and second lender all permit the structure. The buyer must qualify with the new payment. Do not borrow the gap privately and disclose it as savings. See funding an assumption equity gap for a complete payment comparison.

Decide whether to proceed, replace the loan or walk away

Use this sequence:

  1. Confirm the route. If the program does not permit the proposed assumption, price a new purchase loan.

  2. Confirm qualification and liability. If the buyer or required seller release fails, investigate an approved alternative before extending commitments.

  3. Fund the gap. If accepted cash and financing cannot cover the purchase, renegotiate or choose another property.

  4. Compare the complete cost. If a new loan offers a more workable payment, cash requirement or schedule, compare it fairly.

  5. For an existing family owner, compare keeping, assuming, refinancing, buying out another owner or selling. Let the ownership and legal requirements determine which choices are available.

The lowest first mortgage rate is valuable only within a transaction that can actually close and remain affordable.

Documents and responsibilities

Collect the current note and statement, program identification, assumption application, buyer income and asset evidence, credit authorization, purchase or transfer agreement, equity funding records, insurance quote and requested release documents. Add estate or divorce records when applicable.

Person or team ** Work to complete**
Servicer or responsible USDA office Establish the permitted procedure, review, terms and liability treatment
Buyer Supply qualification records and accepted funds for the price gap
Seller Authorize information sharing and confirm the required release outcome
Title professional and counsel Coordinate ownership, liens, agreements and recording
Any second lender Approve the subordinate lien, value, payment and funding

Ask who has authority to approve each part. A real estate agent can coordinate deadlines but cannot issue the servicer's approval or a creditor's release.

How much time should the contract allow?

There is no reliable universal closing period for all these routes. Ask for the current processing estimate, when the file becomes complete, who reviews it, what outside approvals are required and how final documents are ordered.

Then negotiate dates and contingencies with the real estate professionals and attorney. Include time for the equity loan, title work and insurance rather than treating the assumption decision as the only task. If approval will miss a contract date, obtain any necessary extension before the date expires.

Legal and tax boundaries: Counsel should review transfer protections, seller liability, contract remedies and ownership documents. A tax adviser should address family transfers, gifts, sale consequences or subsidy issues. This mortgage comparison does not establish those results.

If you are considering an assumable listing, share the loan type, statement balance, price and available cash with Dane. Those four facts can reveal whether it is worth pursuing the formal review before you spend weeks planning around a payment you may not be able to obtain.
