Florida Short Term Rental Rules

Buying a Vacation Rental With a Kissimmee Address: City or County?

Identify whether City of Kissimmee or unincorporated Osceola County rules govern a proposed vacation rental purchase.

A Kissimmee mailing address does not tell me which rental rules govern the property. The City of Kissimmee says this directly in its development review instructions: an address using the city name may be in unincorporated Osceola County.

For a vacation rental buyer, that distinction changes where to obtain the zoning answer and which approvals to inspect. I would settle it before relying on a seller’s county document or a city rule quoted in an online summary.

Build the address record once

Record the parcel identifier, complete unit or lot designation, legal description and current owner. Open the city’s official development review page and use its Check City Limits link. Match the location to the county property record rather than searching only a community’s marketing name.

Keep a dated copy of the boundary result and the underlying parcel record. If the line appears close or the records disagree, send the parcel identifier and map to the relevant planning offices for confirmation. Do not choose the authority with the more convenient answer.

There should be one governing jurisdiction for the parcel question being asked. Postal delivery, school attendance zones and tourism branding are not substitutes for that determination.

If it is inside the city

Use the City of Kissimmee planning process. Identify the actual zoning, relevant overlays and any parcel or development approvals. Submit the intended rental operation for review under those documents. A county vacation rental explanation should not be substituted for the city’s answer.

Describe whole dwelling or room rental, anticipated stays, guest capacity, owner presence and any mandatory management arrangement. Ask for the provision and approval that authorize that operation, plus any remaining conditions a purchaser must satisfy. Preserve qualifications in the response.

A planning map identifies an important starting fact. It does not establish that every rental pattern is permitted, that every condition has been satisfied or that an existing approval applies unchanged to the purchaser. Obtain the documents that resolve those questions.

If it is in unincorporated Osceola County

Use the county zoning and land use records. The county’s STRPD guidance directs readers to zoning and the short term rental overlay, and flags additional conditions for subdivisions and planned developments. Its general reference page also directs users to the governing code and formal verification.

Match the parcel to its zoning and approval record, including any development order or conditions that matter. An overlay screenshot is a useful lead, not a substitute for reviewing the applicable conditions. Ask whether the proposed use and new operator fit the actual approval.

Where a community contains phases or multiple associations, keep the phase and legal parcel in every request. A document for a similarly named section does not answer the purchase. The association restriction guide explains the separate private document review.

Resolve conflicting answers with a shared set of facts

Imagine a hypothetical seller provides a county zoning email while a buyer finds a restrictive statement on a city website. Neither document should be declared wrong until you establish whether both address the same jurisdiction, parcel and rental model.

Put the documents side by side. Record the address or parcel each covers, the date, the proposed operation described and any conditions. If the property is outside city limits, a city statement may simply be the wrong source. If it is inside, a general county email may not resolve the municipal rule.

If both offices appear to be addressing the same parcel and disagree about authority, request clarification from the offices with the conflicting records attached. A broker’s practical job is to expose the conflict early and obtain the right evidence, not convert uncertainty into an approval.

Move the answer into the deal

Once the governing authority and required approval path are established, identify the buyer’s remaining operating requirements. Public land use, private covenants, state licensing and tax administration still need their own evidence. The Florida address verification guide keeps those tasks separate.

Send any rental limitation or approval condition to the financing and insurance teams. If it changes stay length, management, guest use or opening time, update the revenue evidence and cash budget. Do not leave the original nightly rental forecast in place after learning that its operating assumptions may not fit.

Also separate proof of permission from proof of earnings. A lawful property can have overstated seller revenue. The seller revenue verification guide tests the operating history without pretending that bank deposits establish zoning compliance.

The useful closing file identifies who governs the parcel, what documents support the intended rental use, what conditions remain and who is resolving them before the relevant contract deadline. Kissimmee on the envelope is the beginning of that work, not the answer.
