Florida Short Term Rental Rules

How to Verify That Short Term Rentals Are Allowed at a Specific Florida Address

Verify jurisdiction, public land use permission, association restrictions and operating registrations for the exact Florida parcel.

The mailing address is not the governing rulebook. A property marketed as Orlando, Kissimmee or Davenport may be governed by a municipality or an unincorporated county area with different rental rules.

To verify an STR purchase, identify the exact parcel and intended operation, then obtain evidence from each authority that controls a different part of it. An active listing is evidence of marketing activity. It is not a legal opinion about permitted use.

Write the proposed use in enough detail to get an answer

Before searching a map, describe whether guests rent the whole dwelling or individual rooms, the expected stay lengths, whether a resident remains present, the number of units and guests, owner use, and any management or rental pool arrangement.

“Can I Airbnb this?” leaves important facts undefined. A permission for resident present room sharing does not necessarily authorize an absentee owner to rent an entire house nightly. A permitted monthly lease does not by itself answer the treatment of shorter stays.

Give the same facts to zoning, the association, insurer and financing team. Otherwise each can answer a different version of the proposed business.

Establish parcel identity and governing jurisdiction

Use the county property appraiser's parcel information to identify the legal parcel, unit and ownership record. Then verify incorporated city boundaries through official municipal or county resources. A tax record's mailing city is not enough by itself.

Record the parcel identifier and actual jurisdiction in the purchase file. If the boundary is unclear, obtain confirmation from the relevant planning authority before applying a rule from a nearby address.

Do not treat a community marketing name as a jurisdiction either. A master planned community can contain different legal sections and associations. The particular unit or lot matters.

Verify the public land use permission

Locate the property's zoning district, overlays, planned development approvals and any conditions that apply to the parcel. Then compare the defined permitted use with the operation described above.

Orlando's official home sharing page, for example, distinguishes resident present home sharing from a whole property Commercial Dwelling Unit category. Osceola County directs buyers to confirm zoning and its rental overlay, with additional review for subdivision or planned development conditions. Those are different pathways, not city names to substitute in one generic answer.

A map is a starting point. If the parcel depends on a special approval or older development order, obtain that document and confirm whether its conditions continue for the proposed new owner and use.

Ask the planning office a precise written question identifying the parcel, rental model and source documents reviewed. Preserve its answer and any qualifications. A general statement that a neighborhood has vacation rentals does not resolve a parcel specific condition.

Review the private restrictions separately

Obtain the applicable declaration, amendments, current rules and any rental application or approval conditions for every association affecting the property. A master association and a section association may impose different obligations.

Public zoning permission does not override a valid private restriction. Conversely, an HOA's willingness to approve a tenant does not supply public land use permission.

The detailed association review guide covers minimum stays, frequency, waiting periods, caps and amendment issues. Ask the seller and authorized association representative for the applicable documents rather than relying only on an MLS field.

Complete the operating and tax path

Determine the applicable DBPR classification and licensing requirements for the intended operator and unit. Review the actual application and ownership change process. A seller's displayed license is not proof that the buyer is already authorized to operate under it.

Then identify local business tax or registration requirements and state and local tax collection or filing responsibilities. Florida DOR provides tax registration processes, including a collective process for certain property manager arrangements. That does not establish zoning permission or eliminate every owner's remaining obligation.

If a platform or manager collects some taxes, document which taxes, which bookings and which jurisdictions it covers. Do not assume every channel or direct booking receives the same treatment.

Keep an evidence record that exposes gaps

Item ** What to record**
Parcel and unit Identifier, legal description and exact premises
Jurisdiction Governing municipality or unincorporated county
Proposed use Whole dwelling or rooms, stay pattern, resident presence and capacity
Public permission Zoning, overlay, approval documents, conditions and reviewing office
Private permission All applicable associations, current documents and approval conditions
Operating setup Licensing, local registration, tax responsibilities and ownership transition
Deal consistency Insurance and loan reviewed using the same actual use

Date the evidence and keep the underlying documents. A screenshot without a source or an answer about another unit is weak support for an acquisition.

If a material condition remains unresolved as the purchase decision deadline approaches, treat it as unresolved. The buyer can seek a properly documented extension where available, change the use and rerun the economics, or reconsider the purchase under the actual contract.

I would rely on a chain of address specific evidence, not the fact that nearby listings are active. That is how the rental model becomes a supportable acquisition assumption.
