Florida Short Term Rental Rules

Can You Buy a Whole Home Airbnb Inside the City of Orlando?

Determine whether an absentee whole dwelling rental fits the City of Orlando classification before buying.

An absentee investor cannot use the City of Orlando’s home sharing registration as permission to rent an entire house to vacation guests. That is the first issue I would clear before spending money on an appraisal or an Airbnb furnishing plan.

This does not mean every whole property rental is categorically impossible inside city limits. The city identifies a different use classification. The property has to fit the applicable pathway; changing the description on a loan application does not change the permitted use.

Identify which business you are proposing

The city’s published home sharing program requires a resident to live on site and be present during hosting. It limits the rental portion to no more than half the dwelling and permits one booking at a time. Its requirements also include an association approval letter where a mandatory HOA applies.

The city’s whole home FAQ instead directs buyers to the Commercial Dwelling Unit classification, available only in certain zoning districts and requiring a Business Tax Receipt. Use the official zoning portal and planning review for that proposed use.

Those are materially different operations. An investor who lives elsewhere and gives paying guests exclusive use of the dwelling is not describing resident present room sharing. Hiring a cleaner or a local contact does not make the owner a resident host.

Confirm that the city actually governs the parcel

Begin with the parcel identifier and municipal boundary. Orlando in a listing or mailing address is insufficient. If the property is in unincorporated Orange County, follow that county’s separate classification review. If another municipality governs it, use that municipality’s rules.

Keep the unit identifier with the street address. In a multiunit property, one unit’s approval or advertised activity should not be treated as evidence for another unit. The property type and proposed guest arrangement need to match the answer you obtain.

Make the planning inquiry answer the whole home question

I would provide the parcel, address, current zoning and any known development approval, then describe the operation plainly: the entire dwelling, paying guests, anticipated stay lengths, the owner living elsewhere, the number of units and the intended guest capacity.

Ask which use classification applies, whether it is allowed for that parcel, which approvals or conditions apply, and what evidence a new owner needs before operating. Request the relevant code provision or development order with the response. A comment that home sharing is available does not answer an absentee whole dwelling proposal.

Where the answer depends on an approval, obtain the approval and its conditions. Do not turn a possibility of applying into a purchase assumption that the application will succeed. Likewise, an old seller registration needs review for its scope and the buyer’s proposed operation.

Rebuild the revenue when the allowed operation changes

Suppose a hypothetical buyer projects $72,000 of annual lodging revenue from guests renting the entire house while the buyer lives elsewhere. The buyer then discovers that the only documented path in hand is resident present home sharing.

The $72,000 projection is no longer supported by that permission. It is not reasonable to divide it in half and assume room sharing will earn $36,000. Exclusive use, bedroom count, guest privacy, owner availability and comparable demand have changed.

To investigate a room sharing alternative, build a new model using comparable permitted room rentals and the owner’s actual ability to be present. Identify which nights can be offered. Include the full ownership payment and expenses in the household plan rather than pretending the unused portion of the house costs nothing.

If the buyer will remain an absentee investor, evaluate a different property or a separately permitted rental model. The long term fallback analysis explains how to measure an alternative lease against costs. Permission for one operation should never be used to support another operation’s projected income.

Keep the legal use and the loan file aligned

A lender willing to evaluate projected vacation rent still needs a property and intended use acceptable to its program. A coverage result does not supply local permission. The new Airbnb financing guide addresses rental evidence; it cannot cure a zoning mismatch.

If your plan changes to personal occupancy with limited rental activity, disclose the actual arrangement to the financing team. The vacation home occupancy comparison explains why second home and investment classifications require their own analysis. Personal use is not a label to select solely for pricing.

Review association restrictions and state licensing separately. DBPR classification and a local land use determination answer different questions. Neither an active listing nor collected lodging taxes should be the deciding evidence that an absentee whole dwelling operation is permitted.

Before the applicable purchase decision deadline, I want a written answer tied to the proposed operation. If that answer is still missing, the buyer needs to address the uncertainty through the actual contract and transaction professionals. Budgeting for vacation revenue first and hoping the permission follows reverses the order that protects the investment.
