Florida Short Term Rental Rules

Buying an Airbnb in Unincorporated Orange County: Check the Rental Classification First

Identify the correct county rental category and investigate a proposed use without assuming 30 day stays solve zoning.

Changing an Airbnb listing to a 30 day minimum is not a complete land use analysis in unincorporated Orange County. The county describes more than one rental category, with different stay definitions and zoning treatment. The first step is to identify which category applies to the property and proposed operation.

This page concerns the county’s unincorporated jurisdiction. A property inside the City of Orlando follows the city’s own rules. Use the city whole home rental guide for that question rather than combining the two authorities into one Orlando rule.

Read the county’s categories separately

The county’s published FAQ describes short term rental as stays of 179 days or less, limited to identified commercial and industrial districts or planned developments expressly permitting that use. Separately, it describes single family transient rental as a single family dwelling rented for less than 30 days and identifies R-3 for that category.

Those descriptions are not permission to choose whichever label produces the desired answer. Match the dwelling type and operation to the current code and parcel conditions. Do not infer from R-3 alone that every property, building condition or business arrangement is approved.

I would give the zoning office the full rental proposal and request the applicable classification and provision. If a planned development is involved, obtain its governing conditions. If the property fits more than one description at first glance, that is a reason to resolve the classification explicitly.

Why the 30 day shortcut can fail

A 31 night reservation is longer than a nightly vacation stay. It is still shorter than the broader duration described in the county’s short term rental category. The number 30 by itself therefore does not establish that the proposed operation avoids the county’s rental use restrictions.

The right question is not just whether the booking exceeds 29 nights. It is how the actual dwelling and operation are classified, whether that use is permitted for the parcel and what conditions apply. Get an answer about the proposed minimum stay and use, not a general statement about residential leasing.

Tax treatment is a separate inquiry. Florida’s accommodation tax guidance reaches certain rental periods of six months or less, subject to its exemptions and conditions. A 30 day minimum should not be treated as a general tax exemption either. Do not turn a zoning interpretation into a tax conclusion or vice versa.

Make the planning request specific enough to resolve

Start with the parcel identifier and confirmed unincorporated location. Include the dwelling type, number of units, whole dwelling or room rental, minimum and expected stays, owner presence, guest capacity and any management arrangement. Attach the zoning result and known development documents.

Ask which defined use applies, whether it is allowed under that parcel’s district and approvals, and whether additional conditions or permits must be satisfied before the intended operation begins. Preserve the written response with the provisions and documents it references.

The county’s published business tax process begins with zoning review for unincorporated properties. A tax receipt, a state lodging license or an existing listing should not be substituted for that use determination. The address verification guide explains how to maintain separate evidence for each authority.

Reprice the business if the usable rental model changes

Assume a hypothetical buyer initially expects $78,000 in annual lodging revenue from short vacation stays. The buyer investigates a different, permissible furnished lease model. It is not reasonable to carry the $78,000 into that new forecast simply because the same furniture remains in the house.

For illustration, suppose independent evidence supports $3,200 per occupied month, and the buyer models ten occupied months. Annual collected rent would be $32,000. Assume $14,500 of operating expenses including property taxes, insurance, association charges, utilities and routine management or maintenance; $26,400 of annual principal and interest; and a separate $2,400 replacement reserve.

Owner cash would be $32,000 minus $14,500 minus $26,400 minus $2,400, or negative $11,300 annually. Those are invented modeling inputs, not market rent estimates. No taxes collected for remittance are included as owner revenue, and no loan payment is counted again in operating expenses.

The example does not prove a different rental model cannot work. It shows why a legal use change needs a new financial model. A permissible operation can still be a weak acquisition at the agreed price. The same property rental comparison provides the broader analysis.

Carry the resolved use into the loan and insurance

If stay lengths or operating arrangements change, determine how the selected mortgage investor accepts that rental evidence and qualifies the property. The lender’s long term and short term definitions may differ from a local land use category. Give each reviewer the same underlying facts.

Also update the insurance quote and reserve plan for the actual use. If the purchase only works at the original vacation revenue, treat that dependence as a material decision while the contract still provides an applicable review opportunity.

I would rather identify the wrong classification before an offer than own a house whose only workable spreadsheet assumes a rental business the parcel does not support. The useful result is an answer tied to this property, followed by numbers that fit that answer.
